In May 2011, a New York medical malpractice attorney obtained a $3 million settlement prior to jury selection in a lawsuit involving a 57-year-old woman. The plaintiff sued a New York hospital, her primary care physician, and a radiologist for failure to diagnose in NY. The plaintiff reportedly identified a lump in her breast and told her physician about it, but the radiologist failed to note the presence of an abnormality on the mammogram or sonogram. The lump at that point had metastasized to her left axillary lymph nodes and lungs, making her diagnosis much more serious and her prognosis much more grave than it would have been the year before.

Failure to diagnose in NY leads to unnecessary treatments and sometimes death

An Asian man who had Hepatitis B knew that he was at risk for developing liver cancer, and was careful to see his primary care physician on a routine basis. Yet his doctor failed to order screening studies in 2005, 2006, and 2007, until the man specifically asked for a study in September 2007. The results showed that he had liver cancer. Despite continued treatment, he died in January 8, 2012. His family filed a misdiagnosis lawsuit in New York, and received a settlement of $3.5 million.

A 58-year-old man, for example, was diagnosed with prostate cancer, and went through a prostatectomy. During the procedure, however, he died on the operating table.
